Takedown
RailcarID will remove or disable access to material when it receives a complete notice that the material infringes a copyright. The aim, once a monitored agent exists, is to act the same day and within 24 hours. A notice sent only to the TODO address above may not be seen. Do not rely on it until the TODO line is replaced.
What to include
A notice should include all of the following, in writing:
- A physical or electronic signature of the copyright owner or a person authorized to act for them.
- The work you claim is infringed. A link or a short description is enough to identify it.
- The URL on RailcarID, or another clear way to find the material. A car page, a photo, or a dataset row all count if you identify them.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorized by the owner, the owner’s agent, or the law.
- A statement that the information is accurate, and under penalty of perjury that you are the owner or are authorized to act for the owner.
Send the notice to the designated agent once that contact is published in the box above. Until then, there is no monitored takedown inbox.
What happens next
If the notice is complete and the material is on the site, RailcarID will remove or disable it and record the request: who wrote, what URL, the basis, and what action was taken. If the material was uploaded by a user, that person may receive a copy of the notice. An incomplete notice may be answered with a request for the missing piece, which pauses the clock until it arrives.
The open reporting-mark dataset is a Wikipedia compilation under CC BY-SA 4.0, described on the attributions page. A takedown aimed at that dataset should say which row and why the compilation is not covered by that license. Railroad names in the list are the names the source page printed.
Counter-notice
If your upload was removed and you believe that was a mistake, you may send a counter-notice to the same agent. Include:
- Your physical or electronic signature.
- The material that was removed and the URL where it appeared.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your judicial district, or if you are outside the United States, for any judicial district in which the operator may be found, and that you will accept service of process from the person who sent the original notice.
If the counter-notice is complete and the original sender does not file a court action, the material may be restored after the waiting period the statute requires. TODO: the operator will record counter-notices in the same log as takedown requests once that log exists. This version of the site does not publish user photos, so there is no upload to restore yet.
Repeat infringement
When public uploads exist, an uploader who is the subject of more than one complete notice that results in removal can lose the ability to post. The terms of use say the same thing.
